About these terms
These terms apply to all services provided by HostSA (Pty) Ltd, registration number 2022/450340/07, trading as HostSA.net (“HostSA”, “we”), of M5 Park, Eastman Road, Maitland, Western Cape 7405, South Africa. By placing an order or using our services you agree to these terms, our privacy policy and the acceptable use rules below.
Our services
We provide web hosting, VPS and dedicated servers, domain registration, Microsoft 365 and related services, as described on our website and in your order.
Your account
You must give accurate details when you sign up and keep them up to date. Keep your client area login safe: you're responsible for everything done through your account. You must be 18 or older, or have permission from a parent or guardian.
Prices, invoices and renewal
- Prices are in South African rand and include VAT at 15%.
- Services are billed in advance for the billing cycle you choose, and renew automatically at the end of each cycle until you cancel.
- We email an invoice 10 days before each renewal date, with a reminder before it's due.
- Some services carry a once off setup fee, which is shown before you order.
- We may change our prices. Changes apply from your next renewal, and we'll give you at least 30 days' notice.
Late payment and suspension
If an invoice is still unpaid 5 days after its due date, we may suspend the service until it's paid. We send a reminder before the due date and after it. A service that stays suspended for 30 days may be cancelled and its data deleted. Domains that aren't renewed in time expire under the registry's rules, and restoring them may cost extra.
Domain names
Domains are registered in your name and are subject to the rules of the relevant registry, such as ZACR for .co.za. Renewal prices may differ from the first year price; our domains page shows them. Domain registration fees can't be refunded once the domain is registered.
Acceptable use
You may not use our services to:
- host or send anything illegal, including content that infringes copyright or other people's rights;
- send spam or bulk email that people didn't ask for;
- distribute malware, run phishing sites, or attack or scan other systems;
- mine cryptocurrency on shared hosting, or use resources in a way that harms other customers;
- host content that promotes violence, hate or the abuse of children.
We may suspend a service that breaks these rules, without notice when it's needed to protect our network or other customers, and we'll report illegal content to the authorities.
Backups
Hosting plans include automatic backups as described for each plan. We make backups to help recover from server problems, but we can't guarantee them, so please keep your own copies of important data.
Self managed servers
VPS and dedicated servers are self managed unless you add our server management service. You're responsible for their software, updates, security and backups.
Availability and support
We work to keep our services running at all times but can't promise they'll never be interrupted. We may carry out planned maintenance, and will try to give notice of work that affects your service. Support is available by ticket and email.
Cancellations and refunds
- You can cancel a service at any time from your client area. It stays active until the end of the period you've paid for, and won't renew.
- If you're a consumer who bought online, you may cancel within 7 days of your order and get a refund, less the cost of anything already used up such as a domain registration, as section 44 of the Electronic Communications and Transactions Act allows.
- Apart from that, we don't refund unused parts of a billing period.
Liability
To the extent the law allows, we aren't liable for indirect or consequential loss, such as lost profits, revenue or data, and our total liability to you for any claim is limited to the amount you paid us for the affected service in the three months before the claim. Nothing in these terms limits rights you have under the Consumer Protection Act.
Changes to these terms
We may update these terms. We'll post the new version here, change the date at the top and email you about significant changes. If you don't agree, you can cancel before the change takes effect.
Governing law
These terms are governed by the laws of the Republic of South Africa.
